  • Home buyer can rescind the contract within three business days following the date of signing, without penalty
  • Home builders must register with the Bureau of Consumer Protection
  • A $50 fee from each building permit issued will be paid into a state-administered guaranty fund
  • Guaranty fund will compensate consumers for actual loss resulting from “an act or omission by a home builder in the performance of a home construction contract”
  • For 30 years after a new home is complete, a home builder must provide written notification to a consumer if they are made aware of any defective building material, product or technique
  • A violation of the Act is deemed to be a violation of the Unfair Trade Practices and Consumer Protection law and could carry civil and criminal penalties
